Government benefit programs are “means-tested” with strict eligibility requirements. If your disabled loved one receives a cash gift or an inheritance, they could immediately become ineligible and lose their benefits for a period of time going forward. A special needs trust allows a disabled individual to receive the benefit of an inheritance or other asset while remaining eligible for government benefits. By being able to receive an inheritance and keep their benefits, disabled individuals are able to have a better quality of life. It’s also possible for the money in a special needs trust to be distributed to other family members when the disabled individual passes away thereby keeping assets in the family.
